These Terms of Service constitute a legally binding agreement between you and Breaking The Zone LLC, a Arkansas limited liability company, doing business as Breaking The Zone and breakingthezone.com referred to as “Company,” “SSB,” “we,” “us,” or “our.”

These Terms govern your access to and use of https://breakingthezone.com including all related websites, platforms, software, services, communications, and offerings.

By accessing, subscribing to, or using the Site or services, you agree to be bound by these Terms. If you do not agree, do not use the Site or services.

1. Ownership and Operating Entity

Breaking The Zone is a registered brand operated exclusively by:

All legal, financial, contractual, and operational obligations of Breaking The Zone fall under Breaking The Zone LLC.

2. Definitions

Client
Any person or company requesting services from Breaking The Zone.

Engagement
Any potential or confirmed speaking opportunity, interview, inquiry, or event identified or communicated through Breaking The Zone.

Content
All text, media, software access, videos, training, SaaS tools, and materials provided by the Company.

3. No Guarantee of Results

Clients acknowledge and agree that:

• Breaking The Zone does not guarantee speaker availability
• Breaking The Zone does not guarantee interviews, podcasts or in person appearances.
• Breaking The Zone does not guarantee outcomes as implementation by client or clients team determines outcomes.
• Opportunities identified may or may not result in further communication or contracts

All services are effort based, not outcome based.

6. Payments, Billing, and No Refund Policy

Clients are billed based on services requested and agreed upon.

By contracting with Breaking The Zone, you acknowledge and agree that:

• All requested services will be invoiced as speaker fee and a 50% non refundable down payment shall be made as confirmation of booking.
• Remainder of speaker fee must be paid on or before the day of the event. Failure to do so will result in cancellation of speaking appearance and client will forfeit down payment and full payment shall be due.
• Cancellation stops future billing only

You may cancel at any time. Cancellation does not entitle you to a refund of any previously paid fees.

7. By subscribing and accepting these Terms, you expressly agree that:

• You will not dispute, charge back, or attempt to reverse any transaction
• You understand you are purchasing a speaker service
• All payments are final and non refundable

You authorize the Company to retain records of:

• Your IP address
• Date and time of acceptance
• Checkbox confirmation
• Account access logs

These records may be used to contest disputes or chargebacks.

8. Use of Platform and Conduct

Members agree to:

• Provide accurate and truthful information
• Use the platform lawfully
• Communicate professionally with event organizers
• Not misrepresent the Company or services

The Company may suspend or terminate access for misuse or violations.

9. Intellectual Property

All Site content, software configuration, branding, systems, and materials are owned or licensed by Breaking The Zone LLC.

Unauthorized copying, resale, or redistribution is prohibited.

10. Disclaimer of Warranties

All services are provided “as is” and “as available.”

The Company disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and availability.

11. Limitation of Liability

To the fullest extent permitted by law:

• The Company shall not be liable for indirect or consequential damages
• Total liability shall not exceed the amount paid by the Member in the prior 30 days

12. Indemnification

You agree to indemnify and hold harmless:

• Breaking The Zone LLC
• Breaking The Zone
• Officers, employees, contractors, and representatives

from any claims arising from your conduct, communications, or use of services.

13. Termination

The Company may terminate or suspend access at its sole discretion.

Termination does not entitle the Member to any refund.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Arkansas.

All disputes shall be resolved exclusively in state or federal courts located in Arkansas.

15. Changes to Terms

The Company may update these Terms at any time.

Continued use of the Site constitutes acceptance of any updated Terms.
